These terms and conditions (“Terms”, “Agreement”) are an agreement between GETFUTURA TOURS LCC (“GETFUTURA TOURS LCC”, “us”, “we” or “our”) and you (“User”, “you” or “your”). This Agreement sets forth the general terms and conditions of your use of the Tourvado.com website and any of its products or services (collectively, “Website” or “Services”).

Accounts and membership

Suppose you create an account on the Website. In that case, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it.

Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security.

We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for the our Services. We may block your email and Internet protocol addresses to prevent further registration.

Billing and payments

You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable.

If, in our judgment, your purchase constitutes a high risk transaction, we will require you to provide us with a copy of your valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase.

We reserve the right to change products and product pricing at any time. We also reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.

These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

Accuracy of information

Occasionally there may be information on the Website that contains typographical errors, inaccuracies or omissions that may relate to availability, promotions and offers.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Website or on any related Service is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information on the Website including, without limitation, pricing information, except as required by law. No specified update or refresh date applied on the Website should be taken to indicate that all information on the Website or on any related Service has been modified or updated.

Third-party services

If you decide to enable, access or use third-party services, be advised that your access and use of such other services is governed solely by the terms and conditions of such other services, and we do not endorse, are not responsible or liable for, and make no representations as to any aspect of such other services, including, without limitation, their content or the manner in which they handle data (including your data) or any interaction between you and the provider of such other services. You irrevocably waive any claim against GETFUTURA TOURS LCC with respect to such other services.

GETFUTURA TOURS LCC is not liable for any damage or loss caused or alleged to be caused by or in connection with your enablement, access or use of any such other services, or your reliance on the privacy practices, data security processes or other policies of such other services.

You may be required to register for or log into such other services on their respective websites. By enabling any other services, you expressly permit GETFUTURA TOURS LCC to disclose your data as necessary to facilitate the use or enablement of such other service.

Backups

We are not responsible for Content residing on the Website. In no event shall we be held liable for any loss of any Content.

It is your sole responsibility to maintain appropriate backup of your Content.

Notwithstanding the foregoing, on some occasions and in certain circumstances, with absolutely no obligation, we may be able to restore some or all of your data that has been deleted as of a certain date and time when we may have backed up data for our own purposes. We make no guarantee that the data you need will be available.

Although this Website may be linked to other websites, we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked website, unless specifically stated herein.

We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of their websites.

We do not assume any responsibility or liability for the actions, products, services and content of any other third parties.

Intellectual property rights

This Agreement does not transfer from GETFUTURA TOURS LCC to you any GETFUTURA TOURS LCC or third-party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with GETFUTURA TOURS LCC.

All trademarks, service marks, graphics and logos used in connection with our Website or Services, are trademarks or registered trademarks of GETFUTURA TOURS LCC or GETFUTURA TOURS LCC licensors. Other trademarks, service marks, graphics and logos used in connection with our Website or Services may be the trademarks of other third parties.

Your use of our Website and Services grants you no right or license to reproduce or otherwise use any GETFUTURA TOURS LCC or third-party trademarks.

Disclaimer of warranty

You agree that your use of our Website or Services is solely at your own risk. You agree that such Service is provided on an “as is” and “as available” basis.

We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We make no warranty that the Services will meet your requirements, or that the Service will be uninterrupted, timely, secure, or error free; nor do we make any warranty as to the results that may be obtained from the use of the Service or as to the accuracy or reliability of any information obtained through the Service or that defects in the Service will be corrected.

You understand and agree that any material and/or data downloaded or otherwise obtained through the use of Service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data.

We make no warranty regarding any goods or services purchased or obtained through the Service or any transactions entered into through the Service.

No advice or information, whether oral or written, obtained by you from us or through the Service shall create any warranty not expressly made herein.

Limitation of liability

To the fullest extent permitted by applicable law, in no event will GETFUTURA TOURS LCC, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable to any person for (a): any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use or content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if GETFUTURA TOURS LCC has been advised as to the possibility of such damages or could have foreseen such damages.

To the maximum extent permitted by applicable law, the aggregate liability of GETFUTURA TOURS LCC and its affiliates, officers, employees, agents, suppliers and licensors, relating to the services will be limited to an amount greater of one dollar or any amounts actually paid in cash by you to GETFUTURA TOURS LCC for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

Dispute resolution

The formation, interpretation and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Wyoming without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of Wyoming.

The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the state and federal courts located in Wyoming.

You hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

Changes and amendments

We reserve the right to modify this Agreement or its policies relating to the Website or Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do we will revise the updated date at the bottom of this page. Continued use of the Website after any such changes shall constitute your consent to such changes.

Acceptance of these terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By using the Website or its Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Website and its Services.

Insurance

Insurance is included in all the tours we offer. You are always insured both by us and your transporters.

Refund and Cancellation Policy for multi-day tours

All cancellations must be submitted in writing and emailed to info@tourvado.com. Tourvado.com will utilize the date of receipt of the email to determine when the cancellation is legitimate.

Cancellation of bookings is subject to the following refund restrictions unless specific conditions are agreed upon with the traveler and stated on the travel program:.

  • 25% penalty for cancellations received up to 30 days before the tour date.
  • 50% penalty for cancellations received 30 to 16 days before the tour date.
  • 100% penalty for cancellations received 15 days or less before the tour date.

In all cases of return, you will be charged all non-refundable costs, such as bank fees, bank fees incurred by us for all incoming and outgoing bank transfers from the request, agency fees, and reimbursement fees.

Refund and Cancellation Policy for one-day tours

It would be possible to cancel and get a refund with basically all the tour’s bookings, and we will support you with the refund transactions or a change of date if you request so, after 48 hours before the departure date of the excursion/tour we consider your booking and payment not refundable; for any deposit asked for any group reservation after 2 weeks before the departure date of the excursion/tour we consider your booking and payment not refundable, as it is used to cover and securing the arrangements and organization costs, is always considered not refundable.

In case the guests non-show at pick-up time, the reservation is considered not refundable.

In Details

At Tourvado.com, we strive to be as flexible as possible with our bookings. However, due to commitments with local operators, we do have some restrictions on cancellations and refunds:

  • Cancellations and refund requests made at least 48 hours before the tour departure date will be fully refunded, minus any non-refundable fees such as visa application fees or credit card processing fees. 

[NOTE: To protect you and to be more accommodating than local law, we have obligations to our local collaborators and tour operators, who, on paper and in accordance with Thai law, would only accept a refund request if received 30 days prior to departure. Every refund also entails expenses for the service charges of the utilized merchant accounts and credit cards. In order to properly reimburse the above-mentioned fees, Tourvado.com, which is processing your refund, will keep an 11% service fee. The price we just specified is subtracted from the total sum the guest has paid.]

  • For group reservations requiring a deposit, the deposit is non-refundable if the cancellation occurs less than 2 weeks before departure. This covers costs already incurred by Tourvado.com to secure arrangements with local operators.
  • No-shows on the day of the tour are not eligible for any refund.
  • Late cancellations due to medical reasons must be accompanied by a doctor’s note attesting to the medical condition. With a doctor’s note, the guest is eligible for a 50% refund of the total ticket amount.
  • Changes to tour itineraries or timing due to weather, delays, or other factors will not be eligible for refunds.
  • Once a tour has begun, no refunds will be provided, either full or partial, for any included services, even if they are not used.
  • Refund processing can take up to 10 business days due to procedures required by credit card companies and payment gateways. Tourvado.com processes refunds promptly on our end.
  • Tourvado.com is not responsible for any expenses or rebooking decisions made by guests without our direct knowledge and agreement, in cases where a tour is refunded.
  • Island tours operate rain or shine. If a tour is canceled by Tourvado.com due to dangerous weather, guests can rebook for free on another date or receive a refund.
  • Guest cancellations due to weather concerns will be charged 100% if the weather is safe for operation but potentially intimidating. Rebooking for such situations is possible if done by 5 p.m. the evening before.
  • Tourvado.com is not liable for any tour issues related to timing, vehicle condition, luggage, seating assignments, or denial of boarding due to guest health conditions. These are under the local operators’ control.
  • Tourvado.com is not responsible if the car, minivan, or boat does not leave on time and arrives at the location later than expected. Such concerns must be raised with the local operators. Please bear in mind that, as previously stated, an itinerary can be adjusted for a variety of reasons in order to maximize the tour’s effectiveness. 
  • The tours, activities, and experiences offered through Tourvado.com are provided by independent third party suppliers, not by Tourvado.com itself. These suppliers are independent contractors and not agents or employees of Tourvado.com.

  • Tourvado.com does not own, control, operate, or supervise any suppliers. We act as an agent providing booking services for the supplier products.

  • Tourvado.com is not responsible or liable for any acts, errors, omissions, representations, warranties, breaches, negligence or misconduct of any supplier. The suppliers offering tours, activities or experiences through our platform are solely responsible for compliance with all applicable laws, regulations, rules, and safety standards.

  • Guests participate in any tour, activity or experience at their own risk. Tourvado.com has no liability regarding the performance, safety, legality or any other aspect of the third-party suppliers and their tours, activities or experiences. Any issues must be taken up directly with the relevant supplier.

  • Guest satisfaction and safety are of utmost importance to us. Please contact us immediately if any issue arises so we can address it with the supplier or assist as needed. However, ultimate responsibility lies with the supplier as an independent contracting party.

  • The Tourvado.com suppliers offering tours, activities and experiences through Tourvado.com reserve the right to make changes to the booked program when necessary due to circumstances outside of their control.
  • Suppliers may make minor changes to an activity booking even after confirmation, such as adjusting the order of sites visited or slightly modifying the itinerary timing. They may also make more significant changes to the date, route, location, inclusions or mode of transport of an activity.Reasons for ChangesSome common reasons why a supplier may need to make changes include, but are not limited to:
    • Weather conditions rendering originally planned routes unsafe or inaccessible
    • Unexpected road closures or construction
    • Low or high water levels impacting water-based activities
    • Accidents, emergencies or force majeure events
    • Local holidays or events causing crowds and restrictions
    • Operational issues with transport vehicles, equipment or sites involved
    • There are also other reasons, such as the cancellation of local activities for private events, last minute price changes of local activities that are, at the time of the tour, unaffordable for the operator.

    Notification of Changes

    Suppliers will make reasonable efforts to notify guests of any significant program changes in advance. However, due to the unpredictable nature of some situations, advance notice may not always be possible.

    If a supplier needs to make a major change to an activity after booking, such as changing the date or destination, the guest can choose to accept the change, book an alternate available date or activity, or cancel for a full refund.

    Liability for Changes

    Tourvado.com holds no liability for program changes made by the independent supplier before or during an activity. Any issues must be taken up directly with the supplier. We advise guests to maintain flexibility when booking activities, as changes may happen. 

Please contact our support team by email for any cancellation or refund requests, providing complete booking details and reasons. We will process eligible refunds promptly, minus the necessary mentioned fees per our agreements with local operators and payment processors.
